David Ensignia Tennis Academy Tennis and DETA Pickleball Club Rules and Regulations

David Ensignia Tennis Academy is grateful to have you as part of our tennis family. In order to have the best family-oriented atmosphere, we share with you our Clubs rules, regulations, and policies:

General Rules and Regulations

• All players must be registered with an active online profile at our DETA Wansport platform (tennis) or Court Reserve (Pickleball)
• All waivers must be accepted prior to use any of the Clubs facilities (please read waivers included in the registration at the end of this document)
• All persons using any of the club’s facilities do so at their own risk. DETA, staff and Directors,  assume no responsibility for any accident or injury in connection with such use, or for the loss or damage to personal property. 
• Children under 12 years of age must be supervised by a parent or guardian.
• Although DETA has a lost and found policy, it is not responsible for any belonging left behind
• Only DETA certified staff is allowed to teach at the Clubs
• Proper dress code will be enforced. Adequate tennis shoes, sports outfits, tops must be worn at all times
• Proper tennis etiquette is required at all time. No foul language or disruptive behavior will be tolerated.
• Smoking in not allowed
• Only sport drinks and water allowed inside the courts
• DETA enforces a strict non Alcoholic Beverage Policy at any of the Clubs, unless approved for private or organized events
• Chewing gum or spitting is not permitted 
• Only players allowed inside the courts. Spectators must seat outside at any of our bleachers or guest chairs.
• For everyone safety, no foreign objects will be allowed inside the tennis or pickleball courts, including but no limited to: baby strollers, trolleys, carts, boxes, bicis, skate boards, coolers, balls from any other sports rather than tennis or pickleball, etc,
• The Club has a no cooler policy. Non alcoholic beverage and snacks are sold onsite. There is a Restaurant that offers food and full bar menu.

COURTS BOOKING 

• Tennis and pickleball courts must be booked online and prepaid prior to any use.
• The use of the courts is strictly for private use. Organized activities will not be allowed
• Cancelations will be accepted 6 hrs in advance. Full amount (minus CC fee) will the be credited to your account, no credit card refunds and no refunds/credit after this time.
• In case of rain, and before 30 minutes of use, full court fee will be credited to the account.
• You may use an empty court, prior to your booking time 10 min before or after. Other than that, the full hour will be charged.
  

PROGRAMS REGISTRATIONS

• All players participating in any organized program or clinic must be registered online
• Registration in the programs or clinics can be done online after approval of Head Coach, based on the level of play or meeting the ranking requirements 
• All programs and clinics must be prepaid to ensure participation.
• Make ups will only be offered in case of rain or medical dismissal, up to 2 make ups. (tennis programs)
• As a courtesy and to be entitle to receive the makeup, Head pro must be informed 12 hours in advance.
  

PRIVATE LESSONS

• Lessons must be organized directly with location Head Coach, based on availability. The best coach suitable for your level and goals will be assigned to your lesson.
• Private lessons must be prepaid at the time of confirmation.
• Cancelation is accepted 12 hours prior to the class. After that time no refunds will be issued.
• In case of rain, the class can be re schedule as per both parties convenience. In case of rain after 30 min of lesson, the remaining time will be compensated with extra time in the following lesson.

EVENTS

• All participants must be registered in order to participate.
• Late registrations will be allowed in the case there are still open spots and it wont affect other players or schedules 
• Event cancelation refund policy will vary between 6 hrs up to 24 hrs, depending on the level of the event. Please refer to the event description for more information.
• The Club has a no cooler policy. Non alcoholic beverage and snacks are sold onsite. There is a Restaurant that sales food and full bar menu.
• DETA and DETA Pickleball Club are not responsible for the organization, marketing, promotion, execution, payments and refund policies of any 3rd party events.

Consent for Participation and Medical Treatment

I understand the Academy does not provide student/players insurance and I am responsible for any medical expenses that may be incurred as a result of participation in this activity.
I also acknowledge there are inherent risks involved in any athletic activity.
In consideration of myself/my child participating in this sport, consent is given for emergency medical treatment, hospitalization or other medical treatment by a physician and/or hospital in the event of injury or illness, and waive any liability of David Ensignia Tennis Academy, its agents or employees arising out of such medical treatment. David Ensignia Tennis Academy strives to provide a safe environment by approved and certified tennis coaches and activities that will stimulate and challenge students/players; we cannot guarantee an accident will not occur.
Voluntary participation in supervised sport activities may be one of the least hazardous environments any student/player is involved in.
Although serious injuries are not common in supervised programs, it is impossible to eliminate all risk. Students/players participating in a sport activity must obey all safety rules, report all physical problems to the program or sport activity supervisor and shall be responsible for the safe condition of their own equipment.

Waiver and Release Form

Participant hereby releases, discharges and holds harmless David Ensignia Tennis Academy, and each of its respective officers, directors, agents, employees, volunteers, representatives, sponsors, member organizations, successors and assigns, the venue(s) used (collectively, the “releasees”) from and against any and all claims, demands, damages, causes of action, present or future, whether known or unknown, anticipated or unanticipated, resulting from or arising out of participant’s and participant’s children’s participation in club programs, or any activity or event relating thereto, including travel to and from, and participant does hereby covenant and agree that he/she will not sue or otherwise make any claim against releasees for any reason.
I have read this release and waiver and fully understand its content and have decided to acepted it freely and voluntarily without duress or coercion

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. David Ensignia Tennis Academy has put in place preventative measures to reduce the spread of COVID-19; however, the Academy cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the classes could increase your risk and your child(ren)’s risk of contracting COVID-19.

By acceptiong this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the tennis classes and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Academy may result from the actions, omissions, or negligence of myself and others, including, but not limited to, David Ensignia Tennis Academy employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at David Ensignia Tennis Academy or participation in any of the tennis programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless David Ensignia Tennis Academy, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of David Ensignia Tennis Academy, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any tennis program.

Photo/Video Release and Waiver

By accepting this release and waiver form I am warranting that The David Ensignia Tennis Academy has my permission to use my and/or my child(ren)’s and members of family’s images in photographs and/or videos taken throughout the tennis lessons, practices, tournaments and/or summer camps on and around the tennis courts which the Academy will occasionally use on their website (http://www.davidensigniatennis.com) and/or their social media sites such as Facebook or Instagram, flyers and banners.

I have read this release and waiver and fully understand its content and have decided to accepted it freely and voluntarily without duress or coercion.
